La renta de los empresarios: qué decidir antesIncome tax for business owners: what to decide

For a business owner, the Tax Agency's draft is almost never complete: it has to be reviewed.
Your business income and what you receive from your company must match your books and certificates.
Always simulate both individual and joint returns if you can choose.
Many of the decisions that affect your return can only be taken before December 31.
Every campaign brings changes: review them with your adviser before filing.

For an employee, the income tax return usually means reviewing a draft and confirming it. For a business owner, it doesn't. If you are a sole trader or a partner in a company, your return includes income the Tax Agency doesn't know in detail, expenses only you can justify and decisions that affect how much you pay. These are the key points to check before filing, and the ones to decide well in advance.

El borrador no es tu declaraciónThe draft is not your return

The Tax Agency prepares a draft with the information it has: salaries, withholdings, bank accounts, property. But it doesn't know the detail of your business activity, all your deductible expenses or certain transactions with your company. Confirming the draft without reviewing it is one of the most common ways of overpaying, or of underpaying and receiving a review months later.

Si eres autónomo: cuadra la actividadIf you are a sole trader: reconcile your activity

The income from your activity must come from your income and expense ledgers, and be consistent with what you declared during the year in your quarterly VAT returns and your instalment payments, which are deducted from the final tax due. If the figures don't match, it is one of the first things the Tax Agency picks up.

Also check the expenses you didn't record during the year. Utilities, fees, insurance, training or travel linked to the activity are often forgotten. We have gathered the most common ones in deductible expenses many SMEs overlook. But remember: they are only deductible if they are linked to the activity and properly supported.

Si eres socio de una sociedad: cuadra con lo que te pagaIf you are a company partner: reconcile with what it pays you

What you receive from your company —pay, dividends, interest, rent— must appear in your return and match what the company has reported to the Tax Agency in its withholding returns. Ask for the certificates in good time and check them. If the company pays personal expenses for you, remember they may be benefits in kind that you must also declare.

How you draw income from your company makes a big difference to your return. We explain it in company structure and your income tax return.

Qué documentación tener a manoWhat documents to have to hand

Te ahorrará tiempo y evitará olvidos:Before you sit down to review your return, gather everything that supports it. It will save time and avoid omissions:

Income and expense ledgers for your activity, and the invoices that support them.
  • Certificados de retenciones de tu sociedad, de tus bancos y de cualquier pagador.Withholding certificates from your company, your banks and any other payer.
  • Escrituras y justificantes de compras o ventas de inmuebles, acciones o fondos.Deeds and receipts for purchases or sales of property, shares or funds.
Receipts for pension plan contributions, donations and any expense that gives the right to a deduction.
Last year's return, to check for losses or deductions still to be applied.

Decisiones que se toman al presentarDecisions you take when filing

  • Individual o conjunta. Individual or joint. If you are part of a family unit that can choose, simulate both options. The same one doesn't always win, and it changes from year to year.
Capital gains and losses. If you have sold property, shares or funds, check whether you can offset losses, including those carried forward from previous years within the period allowed by law.
Regional deductions. The Community of Madrid has its own deductions. Check whether any apply to you: they don't always appear in the draft.
Payment method. If you owe tax, you can pay by direct debit or split the payment into two instalments. Direct debit requires filing before the end of the campaign, so it is best not to leave it to the last minute.

Decisiones que había que tomar antesDecisions that had to be taken earlier

Por ejemplo:This is the part most often forgotten: much of what you will pay in your return is decided before December 31 of the previous year, not during the campaign. For example:

How much you pay yourself as a partner and in what form: salary, dividend or leaving it in the company.
Contributions to pension schemes, which reduce the tax base within legal limits.
Bringing forward or delaying business investments and expenses.
Realising losses to offset gains in the same year.

That is why we recommend reviewing each business owner's situation in the last quarter, together with their business's year-end close.

Every year deductions, limits, forms and sometimes the way certain income is declared change. We don't detail them here because they vary from one year to the next, and an out-of-date figure does more harm than none at all. The practical approach is to review the year's changes with your adviser before filing and check which ones affect you specifically.

Confirming the draft without including business income or payments from the company.
Deducting personal expenses as if they were business expenses.
  • No declarar la retribución en especie. Not declaring benefits in kind.
Filing late: there are surcharges, and they grow over time.
Not correcting a known error in time: it is better to rectify on your own initiative than to wait for a request.
